- Histos is a tool for reflection. It is not advice or therapy.
- The Ikigai on the home page is free and needs no account. The full app needs one.
- What you write is yours. We only take the licence we need to store and sync it for you.
- Be a person, not a bot. Don’t abuse the service.
- The app is in early access and provided as is. Our liability is limited.
1. Who we are and what these terms cover
Histos is operated by Alvaro Rodriguez, based in Miami, Florida, United States (“Histos”, “we”, “us”). Histos makes a set of tools for finding and testing what matters to you: an Ikigai map, a graph of your interests, values and skills, and a values-driven journal. These Terms of Service (“Terms”) govern your use of:
- the website at histos.app, including the free Ikigai teaser embedded on it;
- the Histos application at my.histos.app and the Histos apps for macOS, iOS and Android; and
- any related features, content and services we offer (together, the “Services”).
Our Privacy Policy explains how we handle your information and forms part of these Terms. If you have any questions, write to hello@histos.app.
2. Accepting these terms
By using the Services you agree to these Terms. If you do not agree, please do not use the Services.
You must be at least 16 years old, or the age at which you can consent to online services in your country if that is higher, to create an account. If you use the Services on behalf of an organisation, you confirm that you have authority to bind it to these Terms, and “you” includes that organisation.
3. The free Ikigai
The Ikigai view embedded on histos.app is free and does not require an account. It runs entirely in your browser. What you place in the circles is not sent to us and is not saved anywhere by us, so it disappears when you leave or clear the page.
We may change, pause or remove the free teaser at any time. It is offered as a preview of the full app and comes with no promise of availability or support.
4. Your account
The full app requires an account. You agree to give us accurate information, to keep your sign-in details confidential and to tell us promptly at hello@histos.app if you believe your account has been accessed without permission. You are responsible for activity that happens under your account.
If you sign in through a third-party provider such as Google or Apple, that provider’s terms also apply to the sign-in itself. You can delete your account at any time from within the app or by emailing us.
5. Your content
Everything you put into Histos, including your Ikigai items, the nodes and links in your graph, your journal entries, values, goals and library, is your content. You own it. We claim no rights in it beyond the limited licence below.
So that the Services can work, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, back up, transmit, display and process your content, solely to provide the Services to you and to keep them secure. “Process” includes the automated analysis that links journal entries to values and sorts those values into espoused, tested and wobbly. This licence ends when you delete the content or your account, except for copies held in routine backups for the period described in our Privacy Policy.
We will not:
- sell your content or use it for advertising;
- use your content to train general-purpose artificial intelligence models, ours or anyone else’s;
- read your content except where needed to provide support you have asked for, to investigate abuse, or where the law requires it.
You are responsible for what you write. If your content describes other people, make sure you have the right to record it.
6. Histos is a tool for reflection, not advice
Histos helps you notice patterns in what you say and do. The labels it uses, the links it draws between entries and values, and anything it suggests are prompts for your own judgement. They are not medical, psychological, therapeutic, financial, legal or career advice, and they are not a diagnosis of anything.
Automated analysis makes mistakes. Treat what Histos surfaces as a question, not a verdict. If you are in distress or thinking about harming yourself, please contact your local emergency services or a crisis line right away. Histos is not designed for emergencies.
7. Acceptable use
You agree not to, and not to help anyone else to:
- use the Services for anything unlawful or to infringe anyone’s rights;
- probe, scan, overload or interfere with the Services or the systems and networks behind them;
- access the Services by any automated means other than the features we provide, or scrape data from them;
- reverse engineer, decompile or attempt to extract the source code of the Services, except where the law expressly allows it;
- resell, sublicense or offer the Services to third parties as a service of your own;
- circumvent usage limits, security measures or access controls, or share an account with people it was not issued to.
8. Early access, changes and availability
The full app is in early access. Features may be added, changed or removed as it matures, and some parts may be rough. We do our best to keep the Services available but do not guarantee uninterrupted or error-free operation, and we may suspend them for maintenance or for reasons outside our control.
If we ever decide to discontinue the Services or a material part of them, we will give you reasonable notice by email or in the app and a way to export your content first.
9. Paid plans
During early access the full app is free. If we introduce paid plans the following will apply, and we will tell you before you are asked to pay anything.
- The price and billing period are shown before you subscribe. Subscriptions renew automatically at the end of each period until you cancel.
- You can cancel at any time. Cancellation takes effect at the end of the period you have already paid for, and you keep access until then.
- Payments made through the Apple App Store or Google Play are handled, refunded and cancelled through those stores under their rules. Payments made on the web are handled by our payment processor; we do not see or store your full card details.
- If we change a price, we will give you at least 30 days’ notice and the change will apply from your next renewal after that.
- Where you have a legal right to a refund, for example a statutory cooling-off period, nothing here limits it.
For as long as we offer the Ikigai teaser on histos.app, it stays free. We will not put it behind a paid plan.
10. Our intellectual property
The Histos name, wordmark and logo, the software, the design and all content we create belong to us or our licensors and are protected by intellectual property law. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Services and to install and run the apps on devices you own or control.
If you send us feedback, ideas or suggestions, you agree that we may use them freely and without any obligation to you. We will not attribute them to you without your permission.
11. Third-party services
The Services rely on third-party providers, for example for sign-in, cloud hosting, payments and app distribution, and may link to sites we do not control. Their terms and privacy practices govern your use of their services. We are not responsible for third-party services or content, and a link is not an endorsement.
12. Ending the relationship
You may stop using the Services and delete your account at any time. We may suspend or close your account if you breach these Terms, if we are required to by law, if your account has been inactive for a long period, or if we discontinue the Services. Except where doing so would be unlawful or would harm other users, we will tell you why and give you a chance to export your content.
When your account is closed your licence to use the Services ends and we delete your content as described in the Privacy Policy. The sections of these Terms that by their nature should survive (including those on your content, our intellectual property, disclaimers, limitation of liability and governing law) continue to apply.
13. Disclaimers
The Services are provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Services will meet your needs, that the analysis they produce is correct, or that they will be secure, uninterrupted or free of errors.
14. Limitation of liability
To the fullest extent permitted by law, Histos will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, goodwill or opportunity, arising out of or in connection with the Services, however caused and under any theory of liability.
Our total liability to you for all claims relating to the Services is limited to the greater of the amount you paid us in the twelve months before the claim arose and 50 US dollars.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, for fraud, or under mandatory consumer protection rules that apply to you.
15. Your responsibility for claims
If a third party brings a claim against us because of your content or because you have broken these Terms or the law, you agree to cover the reasonable costs and damages we incur as a result, to the extent the claim is your fault. This does not apply where you are a consumer and the law of your country does not allow it.
16. Governing law and disputes
These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-law rules. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in Miami-Dade County, Florida, and you and we each consent to their jurisdiction. If you are a consumer living outside the United States, you also benefit from any mandatory protections of the law of the country where you live, and you may bring a claim in the courts of that country.
If something goes wrong, please write to hello@histos.app first. Most issues can be sorted out quickly and informally, and we would rather do that than go to court.
17. Changes to these terms
We may update these Terms from time to time. The date at the top shows when they last changed. For material changes we will give you at least 14 days’ notice by email or in the app before they take effect. If you keep using the Services after a change takes effect, you accept the updated Terms. If you do not agree, stop using the Services and delete your account before the change takes effect.
18. General
These Terms, with the Privacy Policy, are the whole agreement between you and us about the Services. If any part is found unenforceable, the rest remains in effect. Our not enforcing a provision is not a waiver of it. You may not transfer your rights under these Terms without our consent; we may transfer ours as part of a merger, acquisition or sale of assets, in which case we will tell you.
19. Contact
Questions about these Terms go to hello@histos.app. The app lives at my.histos.app.
